21+ only. You must be 21 or older to purchase tobacco, nicotine, vaping, or hemp-derived products. Valid government ID required. This article is general information, not medical, legal, or health advice.

In Florida, you must be 21 or older to buy vaping, tobacco, or hemp-derived products, and retailers must check a valid photo ID. Delta-8 and other hemp products under 0.3% Delta-9 THC remain legal for adults. Vaping is also banned wherever the Clean Indoor Air Act bans smoking.

How old do you have to be to vape in Florida?

You must be 21 to buy any nicotine, vaping, tobacco, or hemp-derived product in Florida. The state aligned its minimum age with the federal Tobacco 21 law, and a 2023 measure extended the 21+ requirement to hemp products like Delta-8. Retailers are required to verify a government-issued photo ID.

Acceptable IDs include a driver’s license, state ID, military ID, or passport. Shops that sell to anyone under 21 risk penalties, which is why ID checks are standard at every visit.

Is Delta-8 and hemp legal in Florida?

Yes. Hemp-derived products, including Delta-8 THC and CBD, are legal in Florida for adults 21 and older when they contain no more than 0.3% Delta-9 THC by dry weight. Florida follows the federal hemp definition, which is why these products are sold openly in licensed smoke shops statewide.

Hemp law is an active area, so the details can change. This article is general information rather than legal advice; check official state sources for the current rules. See our Delta-8 legality guide.

Where is vaping banned in Florida?

Florida’s Clean Indoor Air Act, amended by voters to include vaping, bans vaping in most enclosed indoor workplaces — restaurants, offices, and similar public spaces. Private homes, designated areas, and some standalone tobacco or vape retailers are exceptions. Always follow posted signs and local rules wherever you are.

Individual cities, counties, and venues can set their own additional restrictions, including at parks and beaches, so local signage is the final word.

Frequently asked questions

Do I need ID to buy a vape in Florida if I look over 21?

Yes. Retailers are expected to verify age with a valid government-issued photo ID regardless of how old a customer appears. Bring ID to every purchase.

Can you buy Delta-8 in Florida without a medical card?

Yes. Hemp-derived Delta-8 under 0.3% Delta-9 THC is sold to adults 21+ without a medical card. A medical card applies to Florida’s separate marijuana program, not hemp products.
